Welcome to XBoost Toolbox. By downloading, installing, or using the XBoost Toolbox mobile application, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the application.
1. Acceptance of Terms
By accessing or using XBoost Toolbox ("the App"), you agree to comply with and be legally bound by these Terms of Use ("Terms"), whether or not you become a registered user. These Terms apply to all users of the App.
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the App after any changes constitutes your acceptance of the new Terms.
2. Description of Service
XBoost Toolbox is a mobile application that provides AI-powered text generation tools across five categories: Writing, Social Media, Business, Study, and Productivity. Key characteristics of the service:
- All AI processing is performed locally on your device
- No internet connection is required for core functionality
- No user account or registration is required
- The app is free to use with advertisements served by Google AdMob
- Generated content is stored locally on your device
3. Eligibility
By using the App, you represent and warrant that:
- You are at least 13 years of age (or the applicable age of consent in your jurisdiction)
- You have the full power and authority to enter into these Terms
- You are not located in a country subject to a U.S. government embargo
- You will not use the App for any unlawful purpose or in violation of any applicable laws
4. User Responsibilities
You agree not to:
- Use the App to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Attempt to reverse engineer, decompile, or disassemble the App
- Circumvent, disable, or interfere with security features or ad delivery
- Use any automated means (bots, scrapers, etc.) to interact with the App
- Modify, adapt, or create derivative works of the App without prior written consent
- Use the App in a way that could damage, disable, overburden, or impair our services
5. Intellectual Property
The App, including but not limited to its design, code, graphics, animations, and user interface, is owned by RED1DEV2 and is protected by copyright, trademark, and other intellectual property laws.
Content generated by you using the App's AI tools belongs to you. However, you grant us a non-exclusive, royalty-free license to use generated content in aggregated, anonymized form for improving the App's AI models (note: since all processing is on-device, no content is transmitted to us).
The XBoost name, logo, and branding are trademarks of RED1DEV2. You may not use these without prior written permission.
6. Privacy
Your privacy is important to us. Please review our Privacy Policy, which explains how we handle your information. By using the App, you consent to the data practices described in our Privacy Policy.
7. Advertising
XBoost Toolbox displays advertisements served by Google AdMob. These advertisements may be personalized based on your device's advertising ID and usage patterns, subject to your consent where required by law (e.g., in the European Economic Area). You may opt out of personalized ads through your device settings.
We do not control the content of third-party advertisements. If you click on an advertisement, you may be redirected to a third-party website or application governed by separate terms and policies.
8. Third-Party Services
The App integrates with third-party services for specific functionality:
- Google AdMob - Serves advertisements within the App
- Google Play Services - App distribution and licensing verification
These third parties have their own terms of service and privacy policies. We are not responsible for their practices.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WE DO NOT WARRANT THAT:
- The App will meet your specific requirements
- The App will be uninterrupted, timely, secure, or error-free
- The results obtained from the App will be accurate, reliable, or suitable for your purposes
- The quality of any products, services, information, or other material obtained through the App will meet your expectations
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RED1DEV2 SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:
- Your use or inability to use the App
- Any content generated by the App's AI tools
- Unauthorized access to or alteration of your data
- Statements or conduct of any third party on the App
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE (12) MONTHS (WHICH IS $0, AS THE APP IS FREE).
11. Indemnification
You agree to defend, indemnify, and hold harmless RED1DEV2 from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the App, your violation of these Terms, or your violation of any rights of another.
12. Termination
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
You may terminate these Terms by uninstalling the App and deleting all local data. All provisions of these Terms which by their nature should survive termination shall survive, including intellectual property provisions, warranty disclaimers, and limitations of liability.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of France.
14. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
15. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and RED1DEV2 regarding the use of XBoost Toolbox, superseding any prior agreements between you and us.
